Avery is a graduate of the University of Louisville and studied law at Transylvania University, earning his juris doctor in 1994. Avery became a prosecuting attorney for the City of Chicago, working for the District Attorney from 1995 until 2001. During the Invasion of Afghanistan, Avery temporarily resigned from his position with the DA's office in Chicago to serve in the United Commonwealth Army, where he was commissioned as a second lieutenant until 2005. Returning from his tour, he was nominated as Undersecretary of the Interior, and was successfully confirmed on June 3rd, 2006. Avery garnered national attention for his testimony on the indictment of Stanley Peterson, at the time Vice Secretariat for charges including obstruction of justice and spoliation of evidence regarding the investigation of the Vice Secretariat's handling of Apple's information data collection system for the Government of Sierra. Avery's handling of the situation ignited tensions between the two nation, a long standing rivalry based on republicanism and support for the monarchy. During the Federalist primaries in 2010, he campaigned against Rahm Emanuel, where he won the majority of the vote, competing heavily in Chicago. Avery carried the cities of Louisville, Northampton, Indianapolis and the majority of the rural voting precincts. During the 2010 general election, Avery challenged Liberal candidate Dan Quayle, winning 56.8% of the popular vote. In 2017 he was expelled from the Federalist Party and forced into a recall election by vote of the National Assembly.
