I would say that the declaration of independence states that we all have a right to life, liberty, and the pursuit of happiness, but, in modern day American, it does not actually grant absolute "liberty", as that would be anarchy, and also the "right to life" has been somewhat ignored (e.g. abortion).

Essentially, the Declaration of Independence cannot grant any rights at all unless the majority (or the main law-making power in America) allow such rights.
