  • Culpable negligence or negligence was a criminal charge that suggested that one's negligence (as opposed to deliberate choice or passionate feeling) was responsible for injury or loss of life. In 2267, Captain James T. Kirk was charged with culpable negligence relating to the apparent death of Records officer Lieutenant commander Benjamin Finney. He plead not guilty. (TOS: "Court Martial" ) In 2373, Odo threatened to arrest Quark for negligence after Benjamin Sisko suffered electrical shock while trying to save a holoprogram in one of the Ferengi's holosuites. He cited Quark's own records, which revealed that the holosuites were badly in need of maintenance. Quark tried to defend himself by saying he'd begged Chief O'Brien to let Rom repair them, but the engineer had said Rom needed to upgrade the sensor array. He further suggested that it was O'Brien who ought to be arrested. Odo replied, " Tell it to the magistrate." (DS9: "Rapture")
