  • A "court-martial" refers to a judicial proceeding within a military or quasi-military organization, or the officer(s) who sit as a court to conduct the proceeding. When a member of StarCon is accused of breaching law or regulations, a court-martial is typically convened. The court-martial reviews the evidence and determines the accused's guilt or innocence. A President of the Court oversees most courts-martial. One famous individual in StarCon who was tried by court-martial was Roger Wilco, after the destruction of the SCS Eureka and murder of Raems T. Quirk.
  • A court-martial was a military court and military court procedure, created to determine punishments for members of the military subject to military law who were found guilty or may dismiss the charges based on the evidence and the case presented. Virtually all militaries maintained a court-martial system to try cases in which a breakdown of military discipline may have occurred. For the Royal Manticoran Navy, the Articles of War and the Manual for Courts-Martial laid down the procedures and regulations for courts-martial. (HH4)
  • A court-martial was a military trial. In the time of the Old Republic, Lieutenant Virk was court-martialed for treason after a series of incidents in which he scammed the officers under his command. • A Court-martial is a military court. These military courts can determine punishments for members of the military subject to military law who are found guilty of a crime or may dismiss the charges based on the evidence and the case presented. If found guilty a person can get off with a simple discharge or face time in a military prison. The correct plural is "courts-martial". In 1998, Major Louis Ferretti was sent after SG-1, who went to the Stargate coordinates they obtained from an Alternate reality, to bring them back for a court-martial. (SG1: "Within the Serpent's Grasp")
  • A court-martial (plural courts-martial) is a military trial chaired by a panel of officers, usually to determine the innocence or guilt of the officer facing charges. The term can also refer to the panel of officers reviewing evidence. Common charges against Starfleet crewmembers or officers facing a court-martial can include, but are not limited to: * Insubordination; * Negligence; * Loss of a starship; * Violation of Starfleet General Orders. Like in any court, the accused is innocent until proven guilty and also has the right to counsel.
  • Most militaries maintain a court-martial system to try cases in which a breach of military discipline may have occurred. Some countries, however, have no courts-martial in time of peace; this is the case in France and Germany, for example, where ordinary, civilian courts are used instead. In addition, courts-martial may be used to try prisoners of war for war crimes. The Geneva Convention requires that POWs who are on trial for war crimes be subject to the same procedures as would be the holding army's own soldiers.

Most navies have a standard court-martial which convenes whenever a ship is lost; this does not presume that the captain is suspected of wrongdoing, but merely that the circumstances surrounding the loss of the ship be made part of the official record.

Like in any court, the accused is innocent until proven guilty and also has the right to counsel. A preliminary hearing is held first to determine whether a court-martial must be faced. If found true, the prosecution is usually conducted by a Starfleet Judge Advocate General. The court-martial panel is comprised of three command or flag rank officers, with the most senior officer taking charge of the panel. Evidence allowed in the trial includes oral and written testimonies, records, sensor readings and exhibits, amongst other things. The person being accused has the right to face his or her accusers, cross-examine witnesses and testify on his or her own behalf. If found guilty, the defendant has the right to introduce evidence that mitigates or explains guilt. (TOS: "Court Martial", "The Menagerie, Part I", "The Menagerie, Part II") Captain John Greene faced court-martial in 2371 after the loss of the USS Prospect during a Special Operations mission to the Gamma Quadrant to make first contact with the Dominion's Founders. (Star Trek: The Prospect Chronicles) This is assumed as Greene was given command of the Galaxy-class USS Prospect-A later in the same year. In 2373, USS Cantabrian commanding officer Noah Wrightson and second officer Antonio Fernandes faced a court-martial, mostly for their disobedience of orders not to interfere with the aftermath of Samantha Delaney's triggering of her folded space drive prototype, a remnant of which was severely affecting a pre-warp planet and its inhabitants. The court marital, comprised of Admiral Zahara Hogan, Captain Liam de Gaillimhe and another Starfleet captain, found both not guilty. (Star Trek: The Cantabrian Expeditions: "Salvation", "Repercussions", "The Betrayed") In the Lyran Starfleet, courts martial were operated on several levels, depending on the gravity of charges faced by the accused, with each county operating an appellate court-martial, as well as superior and summary courts martial. (Star Trek: The Stoneship Files: "Attack on the Laboratory") By 2415 any flag officer could convene a court-martial; however, when a flag officer faced charges, the convening authority had to out-rank the flag officer accused. (Star Trek: False Vacuum: "Murder Grove")

(SG1: "1969") In 2008, when Lt. Colonel John Sheppard led a rescue mission to Michael's cruiser to save Teyla Emmagan against orders. Before that, he told Colonel Samantha Carter she could court-martial him if he survived. (SGA: "Search and Rescue") In 2009, MSgt. During the Clone Wars, clone troopers Fives and Jesse, nearly faced a court-martial during a battle on Umbara, when they disobeyed the orders of Jedi General Pong Krell. Later in the war, in the year 19 BBY, the Republic Navy ensign, Luszgoti, threatened the Null ARC trooper, Ordo with a court-martial when the clone—whom Luszgoti viewed as inferior regardless of his superior captain rank—commanded the subordinate officer to apologize for the disrespect he voiced to the ARC trooper and his adopted father, Mandalorian sergeant Kal Skirata. Luszgoti's court-martial threat was silenced when temperamental clone soldier proceeded to headbutt the junior naval officer, breaking his nose. During the onset of the Second Galactic Civil War in 40 ABY, Colonel Jaina Solo was court-martialed by her twin brother, Colonel Jacen Solo, for disobeying a direct order to destroy a fleeing enemy ship. As a result of her act of insubordination during the Blockade of Corellia, Solo was stripped of her rank and suspended from military duty.
